Joe Giudice has suffered a legal blow following his request to be able to travel back to Italy as he awaits a final decision on his deportation appeal.

Weeks after Joe requested a judge lift the “stay of removal” motion, which would allow the Real Housewives of New Jersey star to vacate the Pennsylvania immigration detention center where he’s been since March and return to his native country, a report has confirmed new details about Joe’s future in ICE custody.

“The motion was referred to Third Circuit Court panel and they will be the ones to decide whether Mr. Giudice can await an appeal decision in Italy,” a court official told Radar Online on October 2.

According to the insider, Joe, the husband of longtime reality star Teresa Giudice, is expected to remain in ICE custody indefinitely.

“There is no telling how long the panel will take to come to a decision,” the official explained.

Although an Attorney General did agree to lift the motion and send Joe back to Italy, a panel of judges was left in charge of making the final call in regard to the RHONJ star’s petition, and there’s no given timeline on when they will do so.

After Joe was ordered to be deported in October of last year after committing crimes of bank and wire fraud, the father of four attempted, unsuccessfully, to appeal the ruling.

During a court hearing last month, Joe, who looked “gaunt” after an alleged 80-pound weight loss, appeared via video in a Pennsylvania courtroom and requested the judge allow him to leave ICE custody and begin working and living in Italy. As an insider previously explained, Joe hasn’t been doing well in the immigration detention center and feels the conditions are unlivable.

“It’s been horrible, and he doesn’t want to rot away [in detainment] any longer. The moment he is denied, he said he will pull his appeal and get ready to go to Italy,” the source said.

The Real Housewives of New Jersey season 10 premieres on Wednesday, November 6 at 9 p.m. on Bravo TV.
